By accessing doittrading.com (“Website”) or using our Trading Indicators or Expert Advisors (“EAs” or “Products”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, do not use our Website or Products.

By using our services, you acknowledge that you have:

  • Read and understood these Terms
  • The legal capacity to enter into binding agreements
  • Accepted all risks associated with trading
  • Agreed to respect our intellectual property rights

2. Eligibility

To use our Products and services, you must:

  • Be at least 18 years old (or age of majority in your jurisdiction)
  • Have the legal capacity to enter into contracts
  • Not be barred from trading by any regulatory authority
  • Be using the Products for lawful purposes only

Trading Eligibility: You acknowledge that trading forex/CFDs may not be legal in your jurisdiction. It is your responsibility to ensure compliance with local laws.

3. Definitions

  • “DoItTrading,” “we,” “us,” “our”: The provider of this Website and developer of the EAs
  • “EA” or “Expert Advisor”: Automated trading software for MetaTrader platforms
  • “License”: The right to use (not own) our software
  • “MQL5 Market”: Third-party marketplace operated by MetaQuotes Software Corp
  • “Bundle”: Package deals sold directly on doittrading.com

4. Purchase Terms

4.1 Individual EA Purchases (via MQL5 Market)

  • All individual EA sales are processed by MQL5 Market
  • Subject to MQL5 Market’s terms and conditions
  • We are not party to the transaction
  • Payment, delivery, and refunds handled by MetaQuotes

4.2 Bundle Purchases (Direct from DoItTrading)

  • Processed directly on doittrading.com
  • Payment via [PayPal/Stripe/Other processors]
  • Instant delivery upon payment confirmation
  • All sales are FINAL – no refunds
  • By purchasing, you waive any withdrawal rights

4.3 Pricing

  • Prices displayed in USD/EUR
  • Subject to change without notice
  • Active licenses not affected by price changes
  • VAT/taxes may apply based on location

5. License Terms

5.1 License Grant

Upon purchase, DoItTrading grants you a:

  • Non-exclusive, non-transferable license
  • Right to use the EA on your MT4/MT5 accounts
  • License for the lifetime of the product
  • Subject to compliance with these Terms

5.2 License Restrictions

You may NOT:

  • Use on multiple accounts (one license = one account)
  • Share, rent, lease, or lend your license
  • Resell or redistribute the EA
  • Transfer license without our written permission
  • Remove or bypass license verification
  • Use for any illegal trading activities

5.3 License Verification

  • EAs require periodic internet connection
  • License verified on startup and periodically
  • We collect: account number, broker name ONLY
  • No trading data is ever transmitted
  • Offline grace period: typically 7 days

5.4 License Termination

Your license automatically terminates if you:

  • Violate any of these Terms
  • Attempt to crack or pirate the software
  • Share or resell your license
  • Initiate a chargeback/payment dispute
  • Engage in any prohibited use

6. Prohibited Uses

You agree NOT to:

  • Reverse engineer, decompile, or disassemble our EAs
  • Modify, adapt, or create derivative works
  • Remove any proprietary notices or labels
  • Use our EAs for market manipulation
  • Employ our products for illegal activities
  • Violate any applicable laws or regulations
  • Interfere with license verification systems
  • Use automated tools to scrape our Website
  • Impersonate DoItTrading or create confusion
  • Harass, abuse, or harm another person

7. Risk Disclaimer and Trading Warnings

7.1 HIGH RISK WARNING

TRADING FOREX/CFDs CARRIES EXTREMELY HIGH RISK AND IS NOT SUITABLE FOR ALL INVESTORS. YOU CAN LOSE ALL YOUR INVESTED CAPITAL.

7.2 No Guarantee of Profits

  • Expert Advisors are tools, NOT guaranteed profit systems
  • Past performance does NOT indicate future results
  • Results depend on numerous factors outside our control
  • Market conditions can change rapidly and unpredictably
  • Technical failures can and do occur

7.3 Your Responsibility

By using our EAs, you acknowledge:

  • You understand and accept ALL trading risks
  • You are solely responsible for your trading decisions
  • You will not hold DoItTrading liable for losses
  • You have sufficient knowledge to use EAs properly
  • You will implement appropriate risk management

7.4 Not Financial Advice

  • We are NOT financial advisors
  • Nothing on our Website constitutes financial advice
  • All content is for educational purposes only
  • Consult qualified professionals for investment advice

8. Intellectual Property Rights

8.1 Ownership

All content on doittrading.com and all Expert Advisors are exclusively owned by DoItTrading and protected by:

  • German Copyright Act (Urheberrechtsgesetz – UrhG)
  • EU Software Directive (2009/24/EC)
  • International copyright treaties and conventions

8.2 Expert Advisor License (NOT Sale)

When you purchase an Expert Advisor:

  • You receive a LICENSE TO USE the software
  • You do NOT receive ownership of the software
  • All intellectual property rights remain with DoItTrading
  • One license permits use on one MT4/MT5 account only
  • License is non-transferable except with our express written permission

8.3 Prohibited Actions

The following will result in immediate license termination and legal action:

  • Reverse engineering, decompiling, or disassembling our EAs
  • Removing, disabling, or bypassing license verification
  • Sharing, reselling, redistributing, or pirating our software
  • Using our code, strategies, or algorithms in your own products
  • Publishing our proprietary strategies without permission
  • Any attempt to crack, hack, or pirate our software
  • Creating derivative works based on our EAs

8.4 Permitted Use

You may:

  • Use the EA on ONE trading account as licensed
  • Create backup copies for personal archival purposes
  • Share your trading results with attribution to DoItTrading
  • Write honest reviews of our products

8.5 Source Code Protection

  • EA source code is CONFIDENTIAL and proprietary
  • Contains valuable trade secrets and strategies
  • Never disclosed to anyone, including purchasers
  • Protected by multiple layers of encryption

8.6 Copyright Enforcement

We actively protect our intellectual property through:

  • Automated piracy detection systems
  • License verification tracking
  • Community reporting programs
  • Legal action against violators
  • Criminal prosecution for commercial piracy

8.7 DMCA Compliance

  • We respect intellectual property rights of others

  • False or bad faith claims may result in legal action

9. Refund Policy

9.1 MQL5 Market Purchases

  • Subject to MQL5 Market refund policies
  • We cannot process refunds for MQL5 purchases
  • Contact MQL5 support directly for refund requests

9.2 Bundle/Direct Purchases

  • ALL SALES ARE FINAL
  • No refunds after purchase and download
  • No cancellations once license is activated
  • By purchasing, you explicitly waive withdrawal rights

9.3 EU Withdrawal Rights

Under EU Directive 2011/83/EU, you normally have 14-day withdrawal rights. However, these rights DO NOT APPLY because:

  • Digital content is delivered immediately
  • You expressly consent to immediate delivery
  • You acknowledge loss of withdrawal rights

10. Limitation of Liability

10.1 No Warranties

OUR PRODUCTS ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • PROFITABILITY OR TRADING SUCCESS

10.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Our total liability shall not exceed the purchase price
  • We are NOT liable for any indirect, consequential, or incidental damages
  • We are NOT liable for lost profits or trading losses
  • We are NOT liable for data loss or corruption

10.3 Trading Losses

YOU EXPLICITLY ACKNOWLEDGE THAT:

  • We are NOT responsible for your trading losses
  • EAs can and will have losing periods
  • Technical failures can cause losses
  • You trade entirely at your own risk

11. Indemnification

You agree to indemnify, defend, and hold harmless DoItTrading from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use or misuse of our Products
  • Your violation of these Terms
  • Your trading activities
  • Your violation of any laws or regulations
  • Any third-party claims related to your actions

12. Privacy and Data Protection

12.1 Personal Data

  • We comply with GDPR and German data protection laws
  • We do not sell your personal data

12.2 License Verification Data

  • We collect minimal data for license verification
  • Only account number and broker name
  • No trading data is ever collected
  • Data encrypted during transmission

13. Termination

13.1 Termination by You

  • Stop using our Products at any time
  • No refund upon voluntary termination
  • License remains valid unless terminated by us

13.2 Termination by Us

We may terminate your license immediately for:

  • Violation of these Terms
  • Copyright infringement or piracy
  • Payment disputes or chargebacks
  • Fraudulent activity
  • Any illegal use

13.3 Effect of Termination

Upon termination:

  • All licenses are revoked (no refund)
  • You must destroy all copies of our EAs
  • Ban from future purchases
  • Potential legal action for violations

14. Governing Law and Jurisdiction

14.1 Applicable Law

These Terms are governed by the laws of:

  • Federal Republic of Germany
  • Without regard to conflict of law principles
  • UN Convention on International Sale of Goods excluded

14.2 Jurisdiction

Any disputes shall be subject to the exclusive jurisdiction of the courts in:
